Terms of Service

Welcome to MyOwnEvents, a platform operated by IdeateAI Inc. ("MOE," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the MyOwnEvents platform, including our website at www.myownevents.com, mobile web applications, and all related services (collectively, the "Platform"). Please read these Terms carefully before using the Platform.
1. Acceptance of Terms
By creating an account, checking the "I have read and agree" checkbox during registration, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. Your act of checking the agreement checkbox constitutes a legally binding acceptance of these Terms (a "clickwrap" agreement).
If you do not agree to these Terms, you must not create an account or use the Platform. Your continued use of the Platform after any modifications to these Terms constitutes your acceptance of the revised Terms as described in Section 19.
If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and the terms "you" and "your" shall refer to both you individually and the organization.
2. Eligibility & Age Requirements
2.1 General Eligibility
The Platform is available to individuals of all ages, subject to the restrictions described below. By using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms or that you have obtained the consent of a parent or legal guardian as required.
2.2 Users Under 13 (COPPA Compliance)
In compliance with the Children's Online Privacy Protection Act ("COPPA"), children under the age of 13 may not create an account or use the Platform without verifiable parental consent. If you are under 13, your parent or legal guardian must create and manage an account on your behalf, provide verifiable parental consent for the collection and use of your personal information, and supervise your use of the Platform. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we discover that we have collected personal information from a child under 13 without appropriate consent, we will promptly delete that information.
2.3 Users Ages 13 to 17 (Minors)
Users between the ages of 13 and 17 ("Minor Users") may create an account and use the Platform with the consent of a parent or legal guardian. By allowing a minor to use the Platform, the parent or guardian agrees to these Terms on the minor's behalf and accepts full responsibility for the minor's activity on the Platform. Minor Users are subject to the following restrictions:
- No paid event creation: Minor Users may not create ticketed (paid) events. This restriction exists because paid event hosting involves financial transactions, tax obligations, and contractual responsibilities that require legal capacity available only to adults (18+).
- No Stripe Connect: Minor Users may not connect a Stripe account or receive payouts from ticket sales.
- No affiliate program: Minor Users may not enroll in or participate in the affiliate commission program.
- Ticket purchases: Minor Users may purchase tickets to events only with parental or guardian approval. The parent or guardian is responsible for all purchases made by the minor.
- Free event creation permitted: Minor Users may create free RSVP events subject to all other applicable Terms.
- Content moderation: All content posted by Minor Users is subject to the same content moderation rules as adult users. Parents and guardians are responsible for monitoring their minor's activity.
2.4 Adults (18+)
Users who are 18 years of age or older have full access to all Platform features, including paid event creation, Stripe Connect payouts, subscription upgrades, and affiliate program participation. Age verification (via date of birth in your profile) is required to access paid event hosting features.
2.5 Parental Responsibility
Parents and legal guardians who permit minors to use the Platform acknowledge and agree that: (a) they are responsible for supervising the minor's use of the Platform; (b) they assume all risks associated with the minor's use, including responsibility for the minor's interactions with other users and attendance at events; (c) they consent to the collection and use of the minor's personal information as described in our Privacy Policy; (d) they are financially responsible for all transactions made by the minor; and (e) they agree to indemnify MOE for any claims arising from the minor's use of the Platform.
3. Account Registration & Security
To access the Platform, you must create an account by providing a valid email address and creating a secure password. During registration, you must check the checkbox confirming that you have read and agree to these Terms and our Privacy Policy. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and current.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Immediately notify us of any unauthorized use of your account.
- Complete email verification before your account becomes fully active.
You may only maintain one account per person. We reserve the right to suspend or terminate accounts that we reasonably believe are duplicates, fraudulent, or in violation of these Terms. You are solely responsible for any activity that occurs through your account, whether or not you authorized that activity. We record your consent to these Terms and our Privacy Policy at the time of registration, including the document version and your browser information, for our records.
4. Event Hosting
4.1 Host Responsibilities
As an event host ("Host") on the Platform, you are solely responsible for:
- Event accuracy: Providing truthful and complete information about your event, including date, time, location, description, pricing, capacity limits, and any applicable age restrictions or special requirements.
- Legal compliance: Ensuring your event complies with all applicable local, state, national, and international laws, regulations, ordinances, and licensing requirements, including but not limited to permits, zoning, health and safety codes, noise ordinances, liquor licenses, and regulations regarding minors at events.
- Age restrictions: If your event should be limited by age — for example, events involving alcohol, which by law require attendees to be 21 or older — setting the appropriate minimum age (18+ or 21+) and complying with all applicable minimum-age and alcohol/liquor laws. Age restrictions on the Platform rely on the date of birth each attendee provides in their own profile; MOE does not verify ages or identities. You remain solely responsible for confirming attendee eligibility at your event. MOE is not liable for any attendee who misrepresents their age, nor for a Host's failure to set or enforce an appropriate age restriction.
- Attendee safety: Taking reasonable measures to ensure the safety and well-being of your event attendees, including Minor Users if your event permits minors. You are solely liable for any injuries, property damage, or incidents that occur at or in connection with your event.
- Cancellation and changes: Promptly notifying attendees of any material changes to your event, including cancellation, venue changes, or schedule modifications. You are responsible for processing refunds to attendees when you cancel or materially alter an event.
- Recurring events: If you create recurring events, you remain responsible for each individual instance, including per-instance capacity management, cancellations, and modifications.
- Co-hosts: If you designate co-hosts for your event, you remain the primary responsible party. Co-hosts act under your authority and you are liable for their actions in connection with your event.
- Event images: Ensuring any images you upload for your event are owned by you, properly licensed, do not infringe on any third-party rights, and comply with our content policies. Images depicting minors require the consent of the minor's parent or legal guardian.
MOE acts solely as a platform facilitating connections between Hosts and attendees. We do not organize, sponsor, endorse, or control any events listed on the Platform. The relationship for event attendance is between the Host and the attendee. MOE is not a party to that relationship and bears no responsibility or liability for the conduct of Hosts or attendees, or for any event-related disputes.
4.2 Host Commercial Responsibilities (Ticketed Events)
If you offer ticketed events through the Platform, you agree to the following additional obligations:
- Merchant of Record. You are the merchant of record for all ticket sales. MOE acts solely as a technology platform and payment facilitator and is not the seller of any tickets.
- Pricing Responsibility. You are solely responsible for setting ticket prices, fees, taxes, and refund policies. You agree not to engage in deceptive pricing practices.
- Consumer Protection Compliance. You agree to comply with all applicable consumer protection laws, including refund rights, cancellation rights, and disclosure obligations.
- Chargebacks and Disputes. You are solely responsible for all chargebacks, payment disputes, and refunds. MOE reserves the right to recover any losses, fees, or penalties incurred as a result of your actions.
- Fraud and Abuse Monitoring. MOE may delay payouts, hold funds, or suspend your account if we reasonably suspect fraud, abuse, excessive chargebacks, or violations of these Terms.
- Event Fulfillment Obligation. You agree to deliver the event as described. Failure to deliver may result in refunds, penalties, account suspension, and potential legal action.
- Taxes and Reporting. You are solely responsible for all applicable taxes, including sales tax, VAT, and income tax obligations related to ticket sales.
- Indemnity for Events. You agree to indemnify and hold harmless MOE from any claims arising from your event, including personal injury, property damage, regulatory violations, or consumer disputes.
4.3 Platform Role Disclaimer
MOE is a neutral technology platform that facilitates connections between users. We do not control, endorse, or guarantee the quality, safety, legality, or accuracy of events, content, or user behavior.
All interactions, transactions, and agreements are solely between users. MOE is not a party to any agreement between Hosts and attendees.
4.4 Organization Profiles
You may create an Organization profile to host events under a branded identity with a team. By creating or managing an Organization profile, you represent that you are authorized to act on behalf of that organization and that the organization name, logo, and information you provide do not infringe any third party's rights. Organization profiles, their follower counts, and events a Host chooses to display on them are publicly visible. Organization owners are responsible for the conduct of their team members, who may act with the permissions granted to their role. Verified-organization badges and trust indicators reflect MOE's reputation signals and are not a guarantee or endorsement by MOE. Organization features available to a profile depend on its subscription tier. An organization may be closed at any time; closure disables hosting and public visibility but does not by itself delete historical event records.
5. Tickets, RSVPs & Refunds
5.1 Event Types
The Platform supports two types of event registration:
- RSVP Events: Free events where attendees confirm their attendance without any payment. Hosts may set capacity limits and enable waitlists.
- Ticketed Events: Paid events where attendees purchase tickets to attend. Prices are set by the Host. Tickets include a unique QR code for check-in verification. Only users aged 18 or older may create ticketed events.
5.2 Ticket Purchases
When you purchase a ticket, you are entering into a transaction with the event Host, not with MOE. All ticket sales are subject to the Host's event terms and refund policies. MOE facilitates the payment processing through Stripe but is not the seller of the ticket. Buying a ticket for another person is permitted. The purchaser is responsible for all charges associated with tickets they buy for other people.
Service fees. By default, a service fee is added to your order at checkout, consisting of (i) the payment processor (Stripe) processing fee and (ii) MOE's platform fee of 2% of the ticket price. The exact amounts are itemized and shown to you before you pay. A Host may instead choose to absorb these fees, in which case no separate fee is added to your order. Service fees are non-refundable — see Section 5.3.
5.3 Refund Policy
Refunds for ticketed events are governed by the Host's refund policy, which may include a refund deadline (hours before the event), automatic refunds upon event cancellation, and post-event refund allowances. MOE does not independently process refunds. If you believe you are entitled to a refund, contact the event Host directly. MOE may facilitate refund processing on behalf of the Host through Stripe. Refunds are processed to the original payment method and may take 5–10 business days to appear on your statement.
Fees on refunds. A refund returns the ticket price only. The service fees described in Section 5.2 (the Stripe processing fee and MOE's 2% platform fee) are non-refundable, consistent with standard industry practice and Stripe's policy of not returning its processing fee on refunds. Where a Host has chosen to absorb the fees instead of passing them to the buyer, MOE's platform fee is returned to the Host upon refund. This policy is disclosed to you at checkout before you pay.
5.4 Splitting an Event's Cost
Hosts may run an event as a cost split instead of selling tickets. In a cost split the Host is recovering expenses they have already incurred, not selling admission. Each participant pays a share, and MOE charges no platform fee on a cost split — only the payment processor's fee applies, which the participant covers on top of their share so the Host receives the full amount. Because a split is not a sale, amounts collected are not revenue to MOE and MOE is not a party to the arrangement between the Host and participants.
Your money goes to the Host, not to MOE. Payments are made directly to the Host's connected Stripe account. MOE never holds, escrows, or controls these funds.
You may also pay the Host directly, outside MOE. Hosts publish Venmo, PayPal and/or Zelle handles (Section 6.5), and a participant may use one of them to send their share straight to the Host. No processing fee applies to that route because no processor is involved. MOE does not process, hold, or see these payments and cannot confirm that one was made. Marking a share as sent records your own statement; the share is treated as settled only once the Host confirms they received it. A payment made this way is not refundable through MOE and any dispute is between you, the Host, and the payment service you used.
Cancellation is between you and the Host. If the event is cancelled, does not happen as described, or you no longer wish to attend, recovering money the Host has already committed to a vendor is the Host's responsibility. MOE cannot guarantee a refund of a cost-share payment and does not underwrite the Host's expenses. Where the Host has set a commit-by deadline, you may withdraw and be refunded yourself before that moment; after it, the Host has typically already committed the money and you must arrange any refund with them directly.
Processing fees are not returned. As with tickets (Section 5.3), a refunded cost share returns the share amount only; the payment processor's fee is non-refundable. Where a split divides a total between however many people join, each participant's share may change as people join or drop out. Anyone who has already paid keeps the amount they agreed to; if that leaves the Host over-collected, the Host may refund the difference. Participants are never asked for more after they have paid.
Hosts are responsible for the accuracy of the costs they record and for any tax consequences of amounts collected. MOE provides expense tracking and summaries as a convenience and does not provide tax or legal advice.
5.5 Waitlist
When an event reaches its capacity, you may join a waitlist. Being on a waitlist does not guarantee admission to the event. If a spot becomes available, waitlisted attendees will be notified in the order they joined. For ticketed events, waitlisted attendees will have a limited-time window (typically one hour) to purchase a ticket when a spot becomes available. Failure to purchase within this window forfeits the offer to the next waitlisted attendee.
5.6 QR Code Check-In
Ticketed events use QR code–based check-in. You are responsible for maintaining access to your QR code. Each QR code is valid for a single use and contains a tamper- detection signature. Sharing, duplicating, counterfeiting, or reselling QR codes is strictly prohibited and may result in denial of entry, ticket cancellation, and account suspension.
5.7 Public & Off-Platform RSVPs
Hosts may invite people who do not have a MOE account ("off-platform guests") by providing their email address (and, optionally, a phone number). Those guests may respond to a free event (Going, Maybe, or Can't Go) through a signed link in their invitation email without creating an account. A Host may also share a guest's signed RSVP link by text message sent from the Host's own device; MOE does not itself send text messages to off-platform guests. Each link is unique to a single invitation and may not be shared or reused. Ticketed events always require an account at checkout. By inviting an off-platform guest, the Host represents that they have a lawful basis to share that person's contact information with MOE for the purpose of delivering the invitation, and that any text message the Host sends complies with applicable law. An off-platform guest may additionally opt in on their RSVP page to receive automated text messages from MOE about that single event (such as date, time, or location changes and cancellations); this consent is recorded, applies only to that event, and ends immediately when the guest replies STOP, removes the opt-in, or declines the invitation. Off-platform guests can view only the single event they were invited to. Accepted off-platform RSVPs count toward an event's capacity in the same way as on-platform RSVPs.
When you share a link to an event, the messaging or social app that receives it may generate a preview card that includes the event's cover image (and, for public events, the event name and description). For private events the preview shows only the cover image. Because anyone who receives a shared link may see this preview, you are responsible for choosing whom you share event links with.
6. Payments & Stripe Connect
6.1 Payment Processing
All payment transactions on the Platform are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By making a purchase or receiving payouts through the Platform, you agree to Stripe's Terms of Service and Privacy Policy. MOE does not store your full credit card information. All payment data is handled directly by Stripe in compliance with PCI DSS Level 1 standards.
6.2 Host Payouts (Stripe Connect)
Hosts who create ticketed events must connect a Stripe account through Stripe Connect to receive payouts from ticket sales. Only users aged 18 or older may connect a Stripe account. Payouts are subject to Stripe's processing timeline, typically arriving within 2–7 business days after the event.
Who pays the fees. Each ticketed event carries two fees: Stripe's payment-processing fee (approximately 2.9% + $0.30 per card transaction; lower for bank/ACH) and MOE's platform fee of 2% of the ticket price. By default, these fees are paid by the buyer as a service fee added at checkout, and the Host receives 100% of the listed ticket price. A Host may instead choose to absorb the fees, in which case both fees are deducted from the Host's payout. MOE's platform fee is 2% in either case — only who bears the fees differs. The applicable amounts are shown to the Host when pricing a ticket and to the buyer at checkout.
6.3 Affiliate Commission Program
MOE offers an affiliate program where eligible users (18+ only) may earn commissions on platform fees generated by referred Hosts. Commission rates are tiered: 20% (base), 25% (Silver, 11–50 referrals), and 30% (Gold, 51+ referrals). Affiliates must meet enrollment requirements including identity verification and an active Stripe Connect account. Self-service payouts are available when approved commissions reach a $10 minimum. Attribution uses a 5-year rolling window per referral with a 30-day signup window. MOE reserves the right to modify commission rates, eligibility requirements, or terminate the affiliate program at any time with reasonable notice.
6.4 Taxes
Hosts are solely responsible for determining and fulfilling their tax obligations related to ticket sales, event income, and affiliate commissions. MOE does not provide tax advice and is not responsible for collecting, reporting, or remitting any taxes on behalf of Hosts or affiliates, except where required by law. You acknowledge that income received through ticket sales or affiliate commissions may be subject to federal, state, and local taxes, and you are responsible for all applicable tax filings.
6.5 Tip Jar/Fee Free Payments
Eligible Hosts may publish their own Venmo, PayPal and/or Zelle details (their "Tip Jar/Fee Free Payments" handles). These handles serve two purposes: they display a tip button on the Host's events, and they allow a participant to settle a share of a cost split directly with the Host (Section 5.4).
Money sent to these handles is paid directly to the Host and does not flow through MOE or Stripe. MOE does not process, receive, hold, or take any fee on such payments, and is not a party to them. Because MOE is not in the payment path, it cannot verify that any such payment was made or received, and any indication in the app that a payment was sent is the payer's own statement until the Host confirms receipt.
Tipping is voluntary, is not a ticket or a guarantee of admission, and is non-refundable through MOE. Payments made to these handles are likewise non-refundable through MOE — any dispute is between the payer, the Host, and the applicable payment service. Hosts are responsible for the accuracy of the handles they provide and for any taxes on amounts received. MOE logs only an anonymous button tap for the Host's analytics and never the amount. Availability may depend on the Host's subscription tier, and a Host must publish at least one such handle before running an event as a cost split.
7. Subscriptions & Service Tiers
The Platform offers multiple service tiers (Free, Pro, Organization, and Enterprise) with varying feature limits. Paid subscriptions are billed monthly or annually through Stripe. By subscribing to a paid tier, you authorize recurring charges to your payment method.
- Free tier: Core event management features with limited availability pool, storage quotas, and no AI assistant access.
- Paid tiers: Enhanced features including expanded availability pools, increased storage, AI assistant access with usage budgets, SMS alerts, and priority support.
- Cancellation: You may cancel your subscription at any time from your profile settings. Cancellation takes effect at the end of your current billing period. No prorated refunds are provided for partial billing periods.
- Downgrades: If you downgrade to a lower tier, certain features may become restricted and data exceeding the lower tier's limits may become inaccessible (but not deleted) until you upgrade again.
8. User Content & Images
8.1 Ownership
You retain all ownership rights to the content you create and submit to the Platform, including event descriptions, profile information, chat messages, bio question responses, and uploaded images ("User Content").
8.2 License Grant
By submitting User Content to the Platform, you grant MOE a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content solely in connection with operating, promoting, and improving the Platform. This license exists only for as long as your content remains on the Platform and terminates when you delete the content or your account, except for content that has been shared with or copied by other users, and except for anonymized data used for AI training as described in Section 10.
8.3 Image Uploads
When you upload images to the Platform (including event images, profile photos, and chat media), you represent and warrant that:
- You own the images or have obtained all necessary rights and permissions to upload them.
- The images do not infringe any third party's intellectual property, privacy, or publicity rights.
- The images do not contain illegal, obscene, defamatory, threatening, or otherwise prohibited content as described in Section 13.
- If images depict identifiable individuals, you have obtained their consent (or the consent of a parent or guardian for minors) for the image to be displayed on the Platform.
- Images depicting minors must not contain any sexually suggestive, exploitative, or otherwise inappropriate content. Violations will result in immediate account termination and referral to law enforcement authorities.
Uploaded images are stored on our servers and may be automatically scanned for content safety using AI-powered moderation tools (see Section 11). Chat images are subject to a 7-day retention period unless explicitly saved by a user. Event and profile images are retained until deleted by the user or upon account deletion.
8.4 AI-Generated Content
The Platform may generate content using artificial intelligence, including event descriptions, birthday messages, and event suggestions ("AI-Generated Content"). Regarding AI-Generated Content:
- No accuracy guarantee: AI-Generated Content may be inaccurate, incomplete, inappropriate, or not suitable for your specific situation. You are solely responsible for reviewing, editing, and approving any AI-Generated Content before it is published or shared.
- No copyright guarantee: AI-Generated Content may not be eligible for copyright protection under current U.S. law. MOE makes no representations regarding the intellectual property status of AI-Generated Content.
- Content appropriateness: While we employ safety measures, AI-Generated Content may occasionally produce outputs that are inappropriate, offensive, or factually incorrect. MOE is not liable for any harm resulting from reliance on or use of AI-Generated Content.
- Right to remove: MOE reserves the right to remove any AI-Generated Content that violates these Terms or our content policies.
8.5 Content Responsibility
You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to submit your User Content and that your content does not violate any third party's intellectual property rights, privacy rights, or any applicable law. MOE reserves the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.
9. AI-Powered Features
9.1 AI Event Assistant
The Platform offers an AI-powered event creation assistant available to paid subscription users. The AI assistant can help with natural language event planning, event editing, friend suggestions, smart scheduling based on friend availability, and event search. When you use the AI assistant, your input (including conversation messages, event details, friend names, aggregated free/busy availability, and other contextual data) is sent to third-party AI providers (currently Anthropic) for processing.
9.2 Automated Features
The Platform also uses AI for the following automated features, some of which are available to all users:
- Auto-generated event descriptions: Available to all users. When you enter an event title, AI may automatically suggest a description. You may edit or replace the suggestion before publishing.
- Event interest scoring: A deterministic scoring engine analyzes 13 signals (including friend attendance, category preferences, location proximity, and past engagement) to rank and recommend public events. Paid tier users may receive enhanced AI-powered scoring.
- Birthday messages and party suggestions: AI-generated birthday wishes and party planning suggestions for your friends. Available to all users.
- AI support chatbot: An FAQ-based chatbot on our support page that can answer common questions and escalate to a human support ticket when needed.
9.3 AI Limitations & Disclaimers
AI-powered features are provided "as is" and are subject to the following limitations: AI may produce inaccurate, biased, or inappropriate outputs; AI features are not a substitute for professional event planning, legal advice, or any professional service; AI assistant usage is subject to your subscription tier's budget limits; and AI features may be temporarily unavailable due to third-party service disruptions. MOE does not guarantee the availability, accuracy, or suitability of any AI-powered feature. You are solely responsible for all decisions made based on AI suggestions.
9.4 AI Usage Budgets
AI assistant usage is metered and subject to monthly budgets based on your subscription tier. When your AI budget is exhausted, AI assistant features will be unavailable until your next billing cycle. Usage tracking includes token counts and associated processing costs. Budget allocation may change at MOE's discretion with notice.
10. AI Data Collection & Training
10.1 Data Sent to Third-Party AI Providers
When you use AI-powered features, certain data is transmitted to third-party AI providers (currently Anthropic) for processing. This data may include your conversation messages with the AI assistant, event details and context, friend names, aggregated free/busy availability (percentages only — never raw calendar event content such as titles, descriptions, attendees, or locations), chat messages (for content moderation), and uploaded images (for safety analysis). Your data sent to Anthropic is processed under their data processing agreement and, as of the date of these Terms, is not used by Anthropic to train their general AI models.
10.2 MOE's Internal AI Training
By using the Platform, you acknowledge and consent to the following: MOE collects and stores data from your interactions with AI-powered features to improve our own AI systems and Platform functionality. This includes:
- Event scoring training data: Input context (anonymized user preferences, event details) paired with scoring outputs and your feedback (thumbs up/down) to improve event recommendation accuracy.
- Content moderation training data: Flagged content paired with moderation decisions (automated and human) to improve our safety systems.
- Event description training data: Event titles paired with AI-generated descriptions and your final edited versions to improve description quality.
- AI assistant training data: Conversation histories, tool calls, user edits, and satisfaction ratings to improve the assistant experience.
- Birthday message training data: AI-generated messages paired with user edits and feedback.
- Support chatbot training data: Questions, answers, and escalation decisions to improve automated support.
Before training data is used, we minimize and, where practicable, pseudonymize the identifiers stored with it. Training data may be used to fine-tune custom AI models operated by MOE and may be exported in JSONL format for model training purposes. Training data is retained indefinitely unless you request deletion. MOE does not use data obtained from connected third-party calendars (Google or Apple) — whether raw or aggregated — to develop, improve, or train any AI or machine-learning model. Our use of Google user data adheres to the Google API Services User Data Policy, including its Limited Use requirements. For more details, see our Privacy Policy.
10.3 Opting Out
You may request deletion of your AI training data by contacting us at support@myownevents.com. Please note that opting out does not retroactively remove your data from models already trained on it, but it will prevent future collection. Anonymized and aggregated data that can no longer be linked to you may be retained for analytical purposes.
11. Content Moderation & Trust and Safety
11.1 Automated Content Moderation
To maintain a safe and respectful environment, user-generated content on the Platform (including event descriptions, chat messages, uploaded images, and profile information) may be automatically analyzed using AI-powered moderation tools. Our moderation pipeline includes automated safety scanning (text analysis and image analysis via Google Cloud Vision), AI-powered contextual review (using Anthropic Claude with surrounding message context), and human review for significant moderation decisions.
11.2 Moderation Actions
Content flagged by our moderation systems may result in content removal (soft-delete), user warnings displayed on your profile, temporary account suspension, permanent account termination for severe or repeated violations, and referral to law enforcement for illegal content. Significant moderation actions (such as account suspension) include human review.
11.3 User Reporting
Users may report content they believe violates these Terms or our content policies. Reports are reviewed by our moderation team. False or abusive reporting may itself result in account action.
11.4 Appeals
You may appeal moderation decisions by contacting us at support@myownevents.com. We will review your appeal and respond within a reasonable timeframe. Appeal decisions are final.
11.5 Child Safety
MOE has zero tolerance for child sexual abuse material (CSAM) or any content that exploits or endangers minors. Any such content will be immediately removed and reported to the National Center for Missing & Exploited Children (NCMEC) and/or applicable law enforcement. Users who upload, share, or distribute CSAM or exploitative content involving minors will have their accounts permanently terminated immediately.
11.6 Human Moderation and Discretion
While MOE utilizes automated systems to detect and flag potentially harmful content, significant moderation decisions may involve human review. Human moderators may review flagged content, user reports, and contextual information to determine appropriate enforcement actions.
MOE reserves the right, in its sole discretion, to remove, restrict, or disable access to any content or account at any time, with or without notice, if we believe such action is necessary to:
- enforce these Terms;
- comply with legal obligations;
- protect user safety; and
- prevent harm to the Platform or its users.
You acknowledge that moderation decisions may involve subjective judgment and that MOE is under no obligation to host or maintain any content on the Platform.
12. Chat & Messaging
The Platform provides messaging features including one-on-one chat, group chat, and event chat. By using these features, you agree to the following:
- Chat messages and media may be automatically scanned for content safety using AI-powered moderation tools as described in Section 11.
- Chat images are subject to a 7-day retention period. After 7 days, unsaved images are automatically deleted. You may save images to extend their retention.
- Media storage is subject to your subscription tier's storage quota. You are responsible for managing your storage usage.
- You may not use chat features for spam, harassment, solicitation, or distribution of illegal or prohibited content.
- MOE may access chat content for content moderation, legal compliance, and in response to valid legal process. We do not actively monitor private conversations except through automated safety systems.
- You may block other users to prevent them from messaging you. Blocked users cannot see your profile or interact with you on the Platform.
13. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Fraud and misrepresentation: Creating fake events, posting misleading event details, misrepresenting your age, or engaging in bait-and-switch practices.
- Ticket fraud: Unauthorized resale, scalping, counterfeiting, or duplication of tickets or QR codes.
- Harassment and abuse: Threatening, harassing, bullying, stalking, defaming, or discriminating against other users based on race, gender, religion, sexual orientation, disability, age, or any other protected characteristic.
- Harm to minors: Any conduct that exploits, endangers, or targets Minor Users, including but not limited to grooming, solicitation, sharing of inappropriate content with minors, or any violation of child protection laws.
- Prohibited content: Uploading, sharing, or distributing content that is sexually explicit, involves CSAM, depicts graphic violence, promotes terrorism or hate speech, or is otherwise illegal.
- Spam and solicitation: Sending unsolicited communications, advertising, or promotional materials through the Platform's messaging features.
- Unauthorized access: Attempting to access other users' accounts, bypassing security measures, reverse-engineering the Platform, or using automated bots or scrapers.
- Illegal activities: Using the Platform to promote, organize, or facilitate any activity that violates applicable local, state, national, or international law.
- Data harvesting: Collecting personal information of other users, including attendee lists, email addresses, or contact details, without their explicit consent.
- Platform manipulation: Creating multiple accounts, artificially inflating event attendance numbers, manipulating ratings or the event scoring system, or abusing the referral/affiliate program.
- AI abuse: Using AI features to generate harmful, misleading, or deceptive content, or attempting to manipulate AI systems through prompt injection or other techniques.
Violation of these prohibitions may result in immediate account suspension or termination, removal of content, forfeiture of affiliate commissions, and, where applicable, referral to law enforcement and legal action.
14. Intellectual Property & DMCA
14.1 Platform Intellectual Property
The Platform, including its design, features, functionality, source code, graphics, logos, trademarks, and all related intellectual property, is owned by MyOwnEvents and is protected by copyright, trademark, and other intellectual property laws of the United States and international jurisdictions. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Platform without our prior written consent.
14.2 DMCA Notice & Takedown
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), if you believe that any content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent at support@myownevents.com with the following information:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the infringing material and its location on the Platform.
- Your contact information (name, address, telephone number, email).
- A statement that you have a good faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing material. We may terminate the accounts of repeat infringers. If you believe your content was wrongfully removed, you may submit a DMCA counter-notification.
15. Disclaimers & Limitation of Liability
15.1 "As Is" Service
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. MOE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
15.2 AI Disclaimer
MOE SPECIFICALLY DISCLAIMS ALL WARRANTIES REGARDING AI-POWERED FEATURES, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, APPROPRIATENESS, OR SUITABILITY OF AI-GENERATED CONTENT. AI FEATURES ARE NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE. MOE IS NOT LIABLE FOR ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT, RECOMMENDATIONS, OR AUTOMATED DECISIONS, INCLUDING BUT NOT LIMITED TO AI-GENERATED EVENT DESCRIPTIONS, SCHEDULING SUGGESTIONS, BIRTHDAY MESSAGES, OR CONTENT MODERATION DECISIONS.
15.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM, INCLUDING AI-GENERATED CONTENT; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) ANY INTERACTIONS WITH OTHER USERS, INCLUDING MINORS; (F) ANY EVENTS ATTENDED OR HOSTED THROUGH THE PLATFORM; OR (G) ANY IMAGES UPLOADED, GENERATED, OR DISPLAYED ON THE PLATFORM.
IN NO EVENT SHALL MOE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO MOE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
15.4 Third-Party Services
MOE integrates with third-party services including Stripe (payments), HERE Technologies (maps and location), Google (calendar synchronization and image moderation), Apple (CalDAV calendar synchronization), Anthropic (AI features and content moderation), Resend (email delivery), Twilio (SMS delivery and phone verification), and Sentry (error monitoring). MOE is not responsible for any failures, outages, data breaches, or service disruptions caused by these third-party providers. Your use of third-party services is governed by their respective terms and privacy policies.
15.5 Event-Related Liability
MOE is a platform that connects event Hosts with attendees. We are not responsible for and disclaim all liability related to: the actions, omissions, or conduct of event Hosts, co-hosts, or attendees; the quality, safety, or legality of events listed on the Platform; any personal injury, property damage, or other harm resulting from attending or hosting events; any disputes between Hosts and attendees, including disputes relating to refunds, event cancellations, or event quality; and any interactions between adult users and Minor Users at events.
15.6 User Conduct & Illegal Activity
MOE provides a platform for event management and does not monitor, endorse, verify, or assume any responsibility for the actions, conduct, or activities of its users, whether online or offline. Users are solely responsible for ensuring that their use of the Platform and all related activities comply with all applicable laws. MOE expressly disclaims all liability for any illegal, unauthorized, harmful, or otherwise unlawful actions by any user of the Platform. Any user who engages in illegal activity through the Platform does so entirely at their own risk and is subject to immediate account termination and potential referral to law enforcement.
This includes compliance with all minimum-age and alcohol/liquor laws. Age restrictions on the Platform (including 18+ and 21+ events) are a tool for Hosts and rely on the date of birth each user provides in their own profile; MOE does not verify any user's age or identity. To the maximum extent permitted by law, MOE is not liable for any user who misrepresents their age, for any Host who fails to set or enforce an appropriate age restriction, or for underage access to or consumption of alcohol at any event.
15.7 Assumption of Risk
You acknowledge that attending or hosting events involves inherent risks, including but not limited to personal injury, property damage, and interactions with other individuals.
By participating in events through the Platform, you voluntarily assume all such risks.
15.8 Release
To the fullest extent permitted by law, you release MOE and its affiliates from any and all claims, demands, and damages arising out of or related to:
- events hosted through the Platform;
- interactions with other users;
- content posted by users;
- any user's misrepresentation of their age, or a Host's failure to set or enforce an appropriate age restriction, including underage access to or consumption of alcohol at an event.
If you are a California resident, you waive California Civil Code §1542.
16. Indemnification
You agree to indemnify, defend, and hold harmless MOE, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or proprietary rights; (d) your User Content, including uploaded images; (e) any event you host, attend, or participate in through the Platform; (f) your use of AI-powered features and reliance on AI-Generated Content; (g) any activity by a minor for whom you are a parent or legal guardian; or (h) any violation of applicable law, including laws relating to the protection of minors.
17. Dispute Resolution & Arbitration
17.1 Informal Resolution
Before filing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@myownevents.com. We will attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved within this period, either party may proceed with formal dispute resolution.
17.2 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof, that cannot be resolved through informal resolution, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or Consumer Arbitration Rules where applicable). The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitration shall take place in the State of California, unless the parties mutually agree otherwise.
17.3 Class Action Waiver
YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.
17.4 Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
17.5 Arbitration Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending written notice to support@myownevents.com within thirty (30) days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in the courts specified in Section 18.
17.6 Jury Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND MOE EACH WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM.
17.7 Venue and Arbitration Logistics
Unless otherwise required by applicable law, arbitration shall be conducted remotely via video conference or, at the election of either party, in the county of your residence. Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
17.8 Batch Arbitration Provision
To the extent permitted by law, if 25 or more similar claims are filed against MOE by the same or coordinated counsel, the parties agree that such claims shall be resolved in staged batches of up to 50 claimants per arbitration proceeding. This provision is intended to promote efficiency and reduce abusive mass arbitration practices.
17.9 Survival
This arbitration agreement shall survive termination of your relationship with MOE.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the State of California, and you consent to the personal jurisdiction of such courts.
19. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will: (a) update the "Last updated" date at the top of these Terms; (b) post the updated Terms on the Platform; and (c) where appropriate, notify you by email or through a prominent in-app notification. For material changes that affect your rights or obligations (including changes to AI data usage, arbitration provisions, or age requirements), we will provide at least thirty (30) days' advance notice before the changes take effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Platform and delete your account.
20. Termination
20.1 Termination by You
You may terminate your account at any time by using the account deletion feature in your profile settings. Upon account deletion, your personal data will be permanently removed through a cascade deletion process, including your profile, events you created, friend connections, chat messages, media files, and associated data, in accordance with our Privacy Policy.
20.2 Termination by MOE
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms; fraudulent or illegal activity; upload of CSAM or content exploiting minors; repeated content policy violations; extended periods of inactivity; or requests from law enforcement or government agencies. Upon termination, your right to use the Platform will immediately cease.
20.3 Effect of Termination
Upon termination, all provisions of these Terms which by their nature should survive termination shall continue in full force and effect, including but not limited to Sections 8 (User Content & Images), 10 (AI Data Collection & Training), 15 (Disclaimers & Limitation of Liability), 16 (Indemnification), 17 (Dispute Resolution & Arbitration), 18 (Governing Law), and this Section 20.
21. Miscellaneous
21.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and MOE regarding the Platform and supersede all prior agreements, understandings, and communications.
21.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
21.3 Waiver
The failure of MOE to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by MOE.
21.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. MOE may assign its rights and obligations under these Terms without restriction.
21.5 Force Majeure
MOE shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, internet outages, or third-party service failures.
21.6 Electronic Communications
By using the Platform, you consent to receiving electronic communications from us, including emails, SMS messages (when opted in), push notifications, and in-app notifications. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing. You may manage your communication preferences in your profile settings. Certain transactional communications (ticket purchases, refund notifications, security alerts, and account-related messages) cannot be disabled, as required by the E-SIGN Act (15 U.S.C. § 7001 et seq.).
21.7 CAN-SPAM & TCPA Compliance
By providing your phone number and opting in, you expressly consent to receive SMS messages from MOE, including transactional messages (such as event confirmations, reminders, security alerts) and, where permitted, promotional messages.
- Consent Standard. Your consent to receive SMS messages is not a condition of purchase.
- Message Frequency. Message frequency may vary depending on your activity.
- Opt-Out. You may opt out at any time by replying "STOP" to any SMS message or by updating your notification settings.
- Carrier Disclaimer. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- TCPA Compliance. MOE complies with the Telephone Consumer Protection Act (47 U.S.C. § 227). You represent that you are the authorized user of the phone number provided and that you consent to receive messages at that number.
- Push Notifications. By enabling push notifications, you consent to receive real-time alerts related to events, messages, and platform activity. You may disable push notifications through your device settings.
- Responsibility for Third-Party Messaging. If you use the Platform to send SMS invitations or notifications to others, you represent that you have obtained all necessary consent from recipients in compliance with applicable law.
